It appearing from the Certificate of Jennet Doak the Executors therein named that she refuses to take upon herself the burden of the execution thereof. Teste.

- p389 -A majority of the voters of Augusta county no doubt sympathized with Daniel Sheffey and other statesmen of the same school in their opposition to the measures which brought on the war of 1812; but when the war arose, no unpatriotic spirit was exhibited in the county. General Porterfield, Colonel Doak, and other officers, although staunch Federalists, exerted themselves to the utmost to prepare the Augusta militia for the field. The war, however, did not approach our borders, and very few of our people actually participated in the conflict.

- p 392 -Colonel Robert Doak, who had commanded the Ninety-third regiment of militia for some years, and had recently been active in raising troops, expecting to go with them to the field, resigned his commission in March, 1813, the brigade commander having designated a junior colonel (Koontz) to command the force detached for service. No doubt the fact that Colonel Koontz was a younger man, led to his appointment by General Porterfield, instead of Colonel Doak. But the veteran of the Revolutionary war was unconscious of approaching age and infirmity, and panting for renown on new fields, felt offended at the act of the general.

Will of Robert Doak
I Robert Doake of Augusta County in the State of Virginia do make my last Will and Testament in manner and form following, Viz:
1st To my Wife Anne Doake I will and bequeath the Tract of land, purchased by me formerly owned by John Doake said to Contain one hundred acres more or less and it is my Will and desire that She have the whole title in fee Simple to the Said Tract of land and its appurtenances the same to be entirely at her disposal I also Will and bequeath to her two of my Slaves viz, a Boy named Isaac and a Girl named Minerva about twelve years of age to have the whole and entire right to said Slaves to dispose of as she may think proper. I further Will & bequeath to her my said Wife Anne Four hundred Dollars in money the same to be paid her by my Executors out of my Estate Twelve months after my decease. I also Will to her the following articles of Household furniture Viz, Two Feather Beds with their Furniture viz the bed she brought to my house & the one called my bed, also two Bureaus one of them being the one She brought the other to be the one used by myself also a small piece of Furniture called a cabinet having a Looking Glass inserted in it I further will to her one of my Grey Mares, the one she may choose to take from the three now on my plantation. Also one good Milk Cow & Calf and three young Lay [sic] two years old, two good Sheep & Sow & Pigs. I also Will to her one years support for herself, the slaves & the Stock herein devised to her off the plantation I now live on after my death.
2nd I Will and bequeath to my Grand son James M Lilley all my Law Books.
3rd To my Daughter Polly I will & bequeath my negro Girl Jinatta.
4th To my Daughter Isabella I will & bequeath my negro Girl Amanda.
5th To my Daughter Dorcas I Will and bequeath my negro Girl Maria.
6th My three Daughters last above named Viz Polly, Isabella and Dorcas, I will & bequeath all my Bank Stock the same being Ten Shares in the Bank of Virginia, to be equally divided with each.
7th To my Daughter Elenor Campbell I Will & bequeath Ten Dollars.
8th To my son John Doake I will and bequeath all the remainder of my Estate both real & personal including my Slaves not herein before bequeathed, He paying first out of the same all my just debts and funeral expenses and supporting my three Daughters, Polly Isabella & Dorcas, in my House as long as they live unmarried, to furnish each of them with a Horse & Saddle as it may be necessary for them to have and such other things as will be required for a decent & comfortable Support. My said Daughters while they live Single & in my House with my son John to Superintend the affairs of the family as to Housekeeping & to give all needful & reasonable assisstance towards providing Clothing for the family, particularly such as Will be needed for the negroes bequeathed to my son John as also those bequeathed to each of them my Daughters which my son is to Support for my Daughters. In the event of any of my three Daughters above named marrying it is my will & desire that in that case, she or they marrying be furnished on leaving my house after marrying with one fourth part of the Household & Kitchen furniture and one fourth part of the Stock of Cattle Hogs & Sheep then on hand after my son John retaining out of the same my Clock, Carpet, Sideboard and Settee. Also Cows & four young Cattle Such as he may select and also either of my three Daughters above named who may marry are to be furnished with a Horse & Saddle to have as their own property.
9th I also Will to my Daughter Jane Lilley her Support in my house to be furnished by my son John out of my Estate herein bequeathed to him if she remains unmarried or as long as she may choose to live with my son John he allowing her to have the use of the Yellow Girl called Callantine to wait on her while she so lives.
And lastly I hereby constitute and appoint my son John Doake Executor to this my last Will & Testament hereby revoking all other former Wills & Testaments by me heretofore made. And it is my desire and I do direct that no security be required of my son John as Executor to this my last Will & Testament, and that he have no Appraisement of my Estate, and that my Grand son James M Lilley assist him in a Settlement of the same with the several Legatees as herein directed.
In Witness whereof I have hereunto set my hand & Seal this second day of June in the year of our Lord One thousand eight hundred & Twenty nine (1829).

I Robert Doake do make this Codicil to the foregoing Will & Testament. I give to my wife Ann Doake in addition to the Legacy bequeathed to her in the foregoing Will that piece or parcel of land lately purchased by me of Nancy Rosannah & Betsy Doake containing Eleven acres Three quarters & Thirty two poles adjoining the land I bought of John Doake & given in this Will to my Wife Ann Doake as heretofore mentioned the exclusive right of which Lands I hereby give & bequeath to her & her heirs forever. In Testimony whereof I have hereunto set my hand & seal this 21st day of September 1830.

This last Will and Testament of Robert Doake decd with a Codicil thereto annexed was presented in Court and the sd Will proved by the oaths of William Brown Edgar T McGuffin and John B Christian three of the subscribing Witnesses thereto and the said Codicil proved by the oaths of John B Christian & Edgar T McGuffin two of the subscribing Witnesses thereto and the said Codicil & Will ordered to be recorded & on the motion of John Doake the Executor therein named who made oath thereunto according to law and entered into bond in the penalty of $20,000 Conditioned as the Law directs which bond is ordered to be recorded. It appearing to the Court by the said Will that the Executor therein named was not required to give security in his Executorial bond. And thereupon the said John Doake took the oath reqd by law. Certificate is granted him for obtaining probat thereof in due form.

Church Register, Bethel Church, Augusta Co and reads: Doak, Eleanor d. Jul 6, 1834 (95 yr) "She was the sister of Col. R. Doak and the eldest of the family". This quotation is from pg 272 of a transcript of the records.
French in "Notable Southern Families" Samuel arrival date (Shenandoah valley VA) as about 1740. Says Samuel Doak received grant in Beverly Manor 23 September 1741.
